The general terms and conditions of Heartcore Learning, located in Rotterdam – Netherlands. Version valid from 5-04-2023.

General

1.1 These general terms and conditions apply to all services and products provided by Heartcore Learning. The terms and conditions are accessible to everyone and can be found on the Heartcore website located in Rotterdam.
1.2 By making a payment for a service or product, you indicate that you agree to the delivery and payment conditions. Heartcore Learning reserves the right to modify its delivery and/or payment conditions after the expiry of the term.
1.3 Unless otherwise agreed in writing, the general or specific terms or conditions of third parties are not recognized by Heartcore Learning.
1.4 Heartcore Learning guarantees that the service or product delivered conforms to the agreement and meets the specifications mentioned in the offer.

Prices

2.1 Prices will not be increased during the validity of the offer, unless legal measures make this necessary or if an intermediary increases the price.
2.2 All prices on the site are subject to typographical errors. No liability is accepted for the consequences of typographical errors.
2.3 All prices on the site are in euros and include VAT, unless otherwise stated (21% for services and most products).

Payment

3.1 Services and products provided by Heartcore Learning must be paid in advance.
3.2 For services provided on an invoice basis, a payment period of 7 or 14 days applies.
3.3 If the client does not pay within the stipulated period, Heartcore Learning has the right to ensure that the client can no longer use its services. Even if the client may no longer be able to use the service, they will still have to fulfill the payment obligation for outstanding invoices.
3.4 When the client has fulfilled all obligations, they will be able to use all services provided.

Delivery and Return

4.1 Delivery of online services and products takes place immediately. If technical problems arise, the client must inform Heartcore Learning and Heartcore Learning will ensure that delivery takes place as agreed as soon as possible.
4.2 Online services and downloadable products cannot be returned, and no refund will be granted as long as Heartcore Learning meets the specifications mentioned in the offer.

Intellectual property

5.1 All services and products offered by Heartcore Learning are covered by its intellectual property. The customer may only use this information for the purpose for which it was provided to the customer, may not reproduce it, and may not modify or remove the copyright, trademark, design, trade name, and other indications.
5.2 Heartcore Learning reserves the right to use the knowledge gained during the execution of its activities for other purposes, provided that no confidential information is disclosed to third parties.

Privacy and confidentiality

6.1 Personal data and data obtained about the client are not shared with third parties by Heartcore Learning unless the client has given written permission.
6.2 Participants in the services of Heartcore Learning also declare confidentiality with respect to all information they obtain about Heartcore Learning and other participants through their participation. This information is confidential and must be treated as such to ensure a safe environment.

Cancellation

7.1 Heartcore Learning reserves the right to cancel the service, refuse participation of a client, or reject the designated person by the client without providing any reasons. In such cases, the client is entitled to a refund of the full amount paid to Heartcore Learning, minus the cost of any services provided until the termination. 7.2 A service can be canceled or rescheduled free of charge up to 48 hours before the appointment. If canceled or rescheduled within 48 hours, Heartcore Learning is entitled to charge the full agreed-upon fee for the service. Missed appointments will be charged in full. If the client is not present or leaves after the start of the session, no refund will be given

Liability

8.1 Clients are fully responsible for their personal health and well-being. Services and products provided by Heartcore Learning are solely intended to support personal development and should be used in this way.
8.2 Heartcore Learning explicitly excludes any liability for personal injury, business damage, or other indirect or consequential damages of any kind.

CHANGES TO TERMS

These terms may be modified by Heartcore Learning by simple notification to the client. In the absence of objection within 30 days of notification, the modified terms will apply to all new agreements as well as all outstanding agreements to be executed after the date of notification.
